Please read these Terms of Service carefully before using the MotorMatch platform. These terms govern your access to and use of our services.
1. Acceptance of Terms
By accessing or using MotorMatch (the "Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained on this Platform are protected by applicable copyright and trademark law.
2. Use of the Platform
You may use the Platform solely for lawful purposes related to buying, selling, or browsing vehicle listings in Canada. You agree not to use the Platform to post false, misleading, or fraudulent listings; harass, abuse, or harm other users; collect personal information without consent; interfere with or disrupt the Platform's infrastructure; or violate any applicable federal, provincial, or local laws.
3. User Accounts
To access certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. MotorMatch reserves the right to suspend or terminate accounts that violate these terms.
4. Vehicle Listings
Sellers are solely responsible for the accuracy and completeness of their vehicle listings, including descriptions, pricing, images, and vehicle history. MotorMatch does not verify listings and makes no guarantees regarding the condition, legality, or safety of any vehicle listed. All transactions are between the buyer and seller. MotorMatch is not a party to any sale.
5. Dealer Accounts
Dealers using the Platform must hold valid dealer licences as required by their province or territory. Dealer accounts are subject to additional terms including listing volume limits, response time expectations, and compliance with all applicable consumer protection regulations. MotorMatch reserves the right to revoke dealer status at its discretion.
6. Fees and Payments
Certain features of the Platform may require payment. All fees are listed in Canadian dollars and are subject to applicable taxes. Subscription fees are billed in advance on a recurring basis. You may cancel your subscription at any time, but refunds are only provided in accordance with our refund policy. MotorMatch reserves the right to change pricing with 30 days' notice.
7. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, icons, images, and software, is the property of MotorMatch or its content suppliers and is protected by Canadian and international copyright laws. You may not reproduce, distribute, or create derivative works without express written permission.
8. Limitation of Liability
MotorMatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to MotorMatch in the twelve months preceding the claim. The Platform is provided "as is" without warranties of any kind, either express or implied.
9. Dispute Resolution
Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the Canadian Arbitration Association. The arbitration shall take place in Toronto, Ontario, and the language of arbitration shall be English. Each party shall bear its own costs.
10. Changes to Terms
MotorMatch reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
